This 'daas ve
hakarah' is the opposite of what the world considers, 'intellect and
reason'.
Sechel/intellect in
the world is considered, 'that which compels you to recognize' –
based on empiricism. A dog also knows when it that it hurts – but
this is not sechel/intellect.
Sechel is a special
gift to the human being. Knowing something because it is true.
Sechel is something the human soul relates to. It is based on an
inner sense, not proof.
A torah judge has to
delve into the details of a case, and seek the principles involved,
but this leads him to 'nukudah ha-emes' a point of truth –
personally relating to it and he then bases his ruling upon it.
So how can two judges
reconcile their opposite rulings?
They can only be
resolved by exposure to 'daas hamachriah' – a third judge with a
unifying view. This may look like an act of compromise, but actually
this is a third opinion.
It is a third way to
which both of the judges agree. And it is not based on overpowering
authority or new compelling evidence, but rather that both unite in
the outlook/daas of the machriah/third judge.
The third judge has a
totally different approach. He sees how it is above.
He comes to know that
which is not knowable. How can he know that which is not known?
Truth as sechel/mind perceives it is not based on mind's perception,
but on the First Being. You cannot dissociate from earth and see how
it is in heaven, but if you climb the ladder that rests on the earth
then you can recognize the truth on earth based on how it is in
heaven. If you work at it, you can recognize heaven on earth. You
can eventually see that this tangible earth is a Godly creation and
then you can judge and rule as it is in heaven. Our task is to
bring heaven down to earth.
What gives a human
being the ability to live on the earth? The view of heaven/sky.
